Terms of Service

1. Acceptance

By accessing or using VideoToPrompt (the "Service") at videotoprompt.app, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service

VideoToPrompt analyzes videos and images you submit and generates text prompts intended for use with AI video and image models. The Service is provided on a freemium basis with free monthly usage limits and paid credit packs for additional usage.

3. Accounts

You must provide accurate information when registering. You are responsible for all activity under your account and for keeping your credentials secure. You must be at least 13 years old (or the minimum age in your jurisdiction).

4. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. In particular, you agree not to upload, generate, or distribute:

• Sexually explicit content or content depicting minors in any sexual context.
• Non-consensual intimate imagery or deepfakes of real people without their explicit consent.
• Content that promotes violence, terrorism, self-harm, or illegal activity.
• Content you do not have the rights to use, or that infringes intellectual property or privacy rights of others.
• Malware, phishing content, or content intended to abuse or deceive.

We reserve the right to review, refuse, or remove content and to suspend or terminate accounts that violate the AUP, without refund.

5. Your Content

You retain ownership of content you upload. You grant us a limited license to process it solely to operate the Service for you (generate prompts, store your history, and provide support). We do not use your uploads to train third-party AI models.

6. Generated Output

Prompts produced by the Service are delivered to you as-is. AI outputs can be imperfect, biased, or unexpected; you are responsible for reviewing outputs before use and for ensuring downstream use complies with the terms of the AI model you apply them to.

7. Credits, Plans, and Payments

• Paid credits are sold as one-time credit packs through our payment processor, Creem.
• Credits are added to your account on successful payment and can be consumed by paid features of the Service.
• Free-tier allowances and credit-pack pricing are displayed on our Pricing page and may change prospectively.
• Refunds are governed by our Refund Policy.
• You are responsible for any taxes not collected by the payment processor.

8. Intellectual Property

The Service, its code, design, and branding are owned by VideoToPrompt and its licensors and are protected by applicable law. These Terms do not grant you any right to our trademarks or branding.

9. Third-Party Services

The Service relies on third-party providers (AI model APIs, payment processing, hosting). Their performance is outside our direct control and is governed by their own terms.

10. Termination

We may suspend or terminate your access for any violation of these Terms or the AUP, or for risk to the Service or other users. You may stop using the Service at any time by closing your account.

11. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEOTOPROMPT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless VideoToPrompt from claims arising out of your use of the Service or your violation of these Terms or the AUP.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which VideoToPrompt operates, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction unless otherwise required by mandatory local law.

15. Changes

We may update these Terms. Material changes will be posted on this page with an updated "Last updated" date. Continued use after changes constitutes acceptance.
